Before the question if declaration of unconstitutionality might be communicated to the consolidate texts, two answers are possible. Firstly, the application by the Constitutional Court of the mechanism of extension of effects, a decision which the Court avoided in this case. The second one, the proposition of a question of unconstitutionality in the frame of the proceeding which reviews the administrative act applying the consolidated text. In this latter case, I will explore the possibility of adopting cautionary measures meanwhile the question of unconstitutionality is resolved. This would allow the Judge of the case to unapply the consolidated text until the constitutional judgement on the main question is decided.La Sentencia del Tribunal Constitucional español 22/2015, de 16 de febrero, ha traído a la actualidad administrativa cuestiones importantes sobre legislación delegada, Derecho autonómico y efectos de la declaración de inconstitucionalidad de la Ley. Ante la cuestión de si la declaración de inconstitucionalidad de la Ley debe comunicarse al texto refundido que la recoge, caben dos respuestas. La primera, que el Tribunal Constitucional aplique la extensión de efectos de la sentencia, opción por la que no se decantó en este caso. La segunda, que se plantee una cuestión de inconstitucionalidad en el marco del proceso en que se recurra un acto de aplicación del texto refundido.
