Finally, it presents a critique of how democracy becomes excluding by keeping the conflict in the same patterns of a class struggle.O presente artigo aborda, em diversos aspectos, as incompatibilidades entre as categorias modernas e ocidentais da política e do direito com as demandas concernentes ao fenômeno migratório, em especial com relação ao problema dos refugiados. Analisa, em um primeiro momento, a insuficiência de teses que partem apenas de um dever moral à inclusão dos refugiados. Em seguida, discute a questão acerca da atribuição de direitos aos imigrantes, sobretudo aos refugiados.
