Through deductive method it was established as general assumptions regarding free access to justice and the right to equality are decimated to an erroneous acceptance of arbitration as an alternative to justice option and not as a mere privatization of the same.En el presente trabajo se pretende realizar un análisis del arbitraje, el cual ha venido siendo identificado como un mecanismo alternativo de solución de conflictos, pero que al estudiar la forma como se ha configurado a través del tiempo y su funcionamiento actual, responde más a un modelo de justicia privada que se encuentra adaptado desde sus mismos orígenes para responder a los intereses de un sector de la población en especial, como son los comerciantes.
