Summary: Abstract: The article aims to compare the regulation of assisted procreation in France and Italy, noting how, because of the numerous interventions of the Constitutional Court, the Italian regulations, originally characterized by a marked protection of the embryo, has assumed an amorphous character and more and more similar to the French legislation. The result is the search for a protection of an alleged right of procreation to the detriment of the child’s right to grow up with both biological parents and of the rights of the unborn, whose status is confirmed extremely ambiguous.
