Summary: This article aims to discuss the accomplishment of the deliberative democracy by the Federal Supreme Court. For the development of this study, references were sought on the works of Ferdinand Lassale, Konrad Hesse, Peter Härbele and Jürgen Habermas. It will be emphasized the elements of popular participation in the juridical process, through the Amicus Curiae institute, the components that shape the democratic character of the argumentative speech and the conformation between social-political reality and the Constitution, assigning which elements of plurality cohesion are given. It concludes that the deliberative democracy is applied by the constitutional justice.
