I turn to some European doctrinal and jurisprudential references to raise my arguments and discussion.El escrito pretende evidenciar las discusiones que se ciernen sobre las decisiones de la Corte Constitucional colombiana alrededor de la subjetivación de los derechos económicos, sociales y culturales (DESC) en contextos de un Estado social de derecho y las falencias que discurren en dichas sentencias constitucionales. Igualmente plantea la naturaleza política del contenido de los DESC como derechos plenos en términos constitucionales.
