This study shows a complex and successful creation of synergies between the European Union and the Council of Europe as exemplified by the activity of the European Union Agency for Fundamental Rights (FRA). The aim of the paper is twofold: first, it examines how the Agency has evolved since its inception a little less than a decade ago. In this sense, the analysis of recent improvement proposals presented by the FRA to the European Commission enables us to assess the gradual overcoming of the low profile with which it was designed; secondly, it outlines the system of institutional cooperation that has been established between the EU and the Council of Europe with a conventional base, complemented by the use of informal channels of relationships, allowing feedback from their respective policies. On this framework, the FRA and the Council of Europe have passed from their initial tension to effective collaboration, avoiding overlapping to enable both to perform their work in the field of human rights, with representatives of the Council of Europe contributing with strong participation in the organic life of the FRA and vice versa. Finally, in view of the growing role of the FRA, the study emphasizes the need to maintain a coherent European human rights policy to which both parties will have to make the necessary adjustments to maintain their synergies, introducing multilevel cooperation in the fields of FRA's activity and choosing a more focused manner to implement joint projects. |
