The Services Directive marks a turning point in classical activity-based
police authorisation. It has been said that the system of administrative police focused
on the prior authorisation has been wiped out by Directive. This chapter discusses the
detailed study of these new techniques that replace the preventive control for posteriori
inspection in a framework of simplification and confidence building in the citizen. The
Spanish Statute 30/1992 introduces for the first time in our general legal regulation
of these two techniques of posteriori inspection, although analysis of the new Article
71bis provides many obscure points I intend to solve: are some, the complex conceptual
demarcation, poor management control of the posteriori inspection, the legal uncertainty
generated criticism or overlapping of requierements. |
