The creation of norms for conciliation must fit into this dynamic, otherwise it frequently leads to distance between norms and social reality. This article is the result of research completed as part of the Masters Program in Theory and Practice of Legal Rulemaking, entitled “A Trialist Theory of Conciliation,” which was directed by Professor Miguel Angel Ciuro Caldani.O direito é uma integralidade pura de fatos, normas e valores. A conciliação, por sua conta, está composta por elementos sociológicos, normológicos e dikelógicos. A elaboração de normas de conciliação deve responder a essa dinâmica, do contrário, fica sujeito ao distanciamento frequente entre norma e realidade social. O presente artigo é produto da pesquisa terminada dentro do mestrado em Teoria e Prática da Elaboração de Normas Jurídicas denominada “Uma teoria tridimensional da conciliação”, a qual foi orientada pelo professor Miguel Ángel Ciuro Caldani.El derecho es una integralidad pura de hechos, normas y valores. La conciliación, por su cuenta, está compuesta por elementos sociológicos, normológicos y dikelógicos. La elaboración de normas de conciliación debe responder a esta dinámica, de lo contrario, queda sujeto al distanciamiento frecuente entre norma y realidad social.
