The article also determines the necessary conditions for the existence of this kind of bays; for this purpose it describes different concepts like international custom, historic titles, effective possession, acquiescence, the time factor and prescription on public international law.El presente artículo estudia la evolución histórica de los conceptos de aguas y de bahías históricas, para luego entrar a analizarlos como excepción al artículo 10 de la Convención de las Naciones Unidas sobre el derecho del mar, de 1982. Asimismo, se determinan las condiciones y los requisitos necesarios para la existencia de este tipo de bahías.
