Rosenn study. The brazilian legal culture is strongly linked to the jeito institution, whose roots go back to its colonial past and the strong portuguese imperial influence. Besides major obstacle to the development of the country is also seen as a way to avoid social conflicts until you find an appropriate consensual solution. The advent of the Courts of Accounts reflected in many aspects to culture of jeito, both the delay in recognizing the necessity of the existence of external control over the public administration, such as the conflicts generated from the beginning of its activities of inspection. Even today there are clear signs that this culture persists in brazilian society with damage to the control of public administration. It is essencial to overcome it, strengthening the rule of law and giving due importance to punishment when appropriate.O trabalho tem por objetivo relacionar a instituição do jeito na cultura jurídica brasileira com a atuação dos Tribunais de Contas, a partir do estudo de Keith S. Rosenn. A cultura jurídica brasileira é fortemente ligada à instituição do jeito, cujas raízes remontam ao seu passado colonial e à forte influência imperial portuguesa. Além de grande empecilho para o desenvolvimento do país, também é visto como um modo de evitar conflitos sociais até que se encontre uma solução consensual adequada. O surgimento dos Tribunais de Contas refletiu em diversos aspectos a cultura do jeito, tanto na demora em se reconhecer a necessidade da existência do controle externo sobre a administração pública, como nos conflitos gerados a partir do início de suas atividades fiscalizatórias.
