Thus the European Central Bank (ECB) will assume the prudential supervision of the most important credit institutions of the euro zone. The new system raises many issues. It is necessary to assess whether transferring prudential supervisory tasks to the European Central Bank is in conformity with the TFEU. The ECB shall carry out its supervisory tasks independently and separately from its tasks related to monetary policy. European and national legislation are intertwined, so that European and national authorities must cooperate closely. It is necessary to strike a balance between efficiency and guarantee in the exercise of supervision. Judicial review finds its limits in the exercise of administrative discretionary powers. El mecanismo unificado de supervisión es una pieza esencial de la unión bancaria, que expresa la mayor integración financiera a que aspiran los países de la zona euro. En su virtud, el Banco Central Europeo (BCE) asumirá la supervisión prudencial de la mayor parte del sistema bancario de los países que comparten moneda. Se plantean con ello numerosas cuestiones. Es preciso valorar si el nuevo mecanismo es conforme con el TFUE. El BCE deberá ejercer sus funciones de supervisión con independencia y separación respecto de la política monetaria. El entrecruzamiento entre la normativa europea y nacional exige una exquisita cooperación entre ambas autoridades. Es también preciso encontrar el equilibrio entre eficacia y garantía en el ejercicio de la función de supervisión. La discrecionalidad administrativa dificulta el control judicial efectivo en este ámbito.
