Summary: One of the major issues currently being debated around young offenders is that if it is a social or legal problem, since this problem should be considered not from the legal point of view but from the social field, because is not possible that a child is able to be judged when is not an adult and when he or she commits an offense or crime that is nothing else but the product of a generality of problems and events not attributable to him or her. With the current applicable law, instead of helping them, they are repressed, confused and confined what it prevents them to have a proper development.
