The state-owned voluntarism will, so, lose the public monopoly, disconstituting the trap of getting private goods from everyone, prepared by coding paradigm.Realiza-se um esforço teórico para resgatar a eficácia do conceito de Função Social, partindo do Direito Romano. O primeiro passo é rever a classificação dos bens em públicos e privados, legada pelos códigos, para devolver à Sociedade a tutela jurídica dos bens coletivos ou sociais fundamentais.
