In section II , the focus is on the private sphere, looking at both the different conflicts of interests arising in the regulatory relationships and the need for governance responses. In section III , institutional complementarity between public and private regimes is examined. In light of this approach, the claim that differences between public and private at the global level exist is substantiated. The public-private divide is analysed, comparing the domestic and the transnational level. Four different models of interaction are identified: hybridization, collaborative law-making, coordination, and competition. Section IV summarizes the results of the analysis, reconsidering the boundaries between public and private at transnational level.En la sección I de este artículo los factores que dirigen el surgimiento de la nueva Regulación Privada Transnacional son identificados en comparación con, de una parte, el derecho de los mercados y, de la otra, el régimen público internacional. En la sección II, la discusión se centra en la esfera privada, analizando los dos conflictos de interés que surgen de las relaciones entre regulado y regulador y la necesidad de respuestas desde la regulación. En la sección III, se analiza la complementación entre los regímenes públicos y privados. A la luz de esta aproximación en el presente texto se defiende el argumento de la existencia de diferencias entre lo público y lo privado en el ámbito global. La diferencia entre lo público y lo privado se analiza comparando el ámbito doméstico con el transnacional. Cuatro modelos diferentes son identificados: hibridación, creación normativa por colaboración, coordinación y competencia.
