To this end, certain principles were laid down in the Constitution and other legislative bodies; within these we find in particular is the principle of �social function of contract�. Considering the increase in international business transactions and the recent accession of Brazil to the Vienna Convention on Contracts for the International Sale of Goods International Sale and Purchase of Goods-a widely uniform law governing such contracts and is based on purely commercial principles and international principles- it is necessary to analyze the constitutional aforementioned principle mentioned, considering the new business scenario in which it will act apply.El incremento de las relaciones comerciales durante los últimos años es una de las razones por las cuales la utilización de los contratos como medio para expresar la voluntad de las partes se ha tornado cada vez más frecuente. Ante este cambio, el Estado brasilero se vio en la necesidad de establecer parámetros capaces de preservar y limitar los efectos sociales que estas relaciones producirían en la comunidad. Con este fin, determinados principios fueron establecidos en la Constitución y en otros cuerpos legislativos, dentro de los cuales destaca el principio de la función social del contrato.
