Summary: The unconstitutional state is a jurisprudential tool and has its origin like a mechanism created to protect the fundamental rights of the population in Colombia. This had its development in the Constitutional Court, through such a figure has promoted the realization of the rights of groups that have suffered serious violations thereof. In Colombia on several occasions has declared unconstitutional state, because they have encountered situations that have merited because of the massive and systematic violation of fundamental rights, failure of the authorities responsible for measures that seek to ensure such rights, massive use protection mechanism as a defense of the rights violated, among others, these situations have created a strong social problemthatwarrants collective action of public authorities to assist in overcoming them. Thanks to the existence of this figure, vulnerable populations such as people living in displacement, the prison population and human rights defenders have received a setback in the ongoing struggle to protect their fundamental rights.
