Summary: Reaching criminal responsability, justice and reconciliation are the three main objectives safeguarded for the transition and consolidation of a democratic State in societies with armed confl ict or post confl ict situations. However, the forms chosen to gain such objectives places in balance the use of several mechanism of transitional justice and criminal prosecution, especially in prolonged armed confl icts like Colombia�s. The purpose of this article is to critically evaluate transitional justice mechanisms and their dualistic role as part of an integral system of peace that intends to achive the objectives mentioned; to conclude that their usage does not imply the renounce of criminal justice, owing to preserve the international obligation to prosecute abuses against international humanitarian law and human rights.
