Summary: This article proposes a sociological discussion around the issue of missing persons as actors that set a crisis in terms of legislative categories and that promote -from its absence- a dispute on representation in the fi eld of law. With an example located in Tijuana during recent years of violence, it is possible to see how the relatives of missing persons interpellate institutions to reform the articles about Presumption of Death statewide, while identifying themselves as victims of violence. These experiences indicate the need to recognize the victims for the repair of violence legally and the resolution of grief at the individual and collective scopes.
