The aim of this article is to bring again into discussion the subject of short-term freedom deprivation penalty, emphasizing that the inexpidients related to the shortterm deprivation penalties are also in the long-term deprivation penalties. Although every freedom deprivation penalty is damaging for the individual, the more longer it is, the more damaging it will be to the individual�s personality, reducing the possibilities of social reinstatement. In this way, it is affirmed that it is not true that the short-term penalties of imprisonment are worst, or has more flaws than the long ones, as it was defended for a long time. It is sustained that, in reality, what occurs is the opposite due to the fact that the long-term freedom deprivation penalties causes, almost everytime, some sort of mismatch in a irreversible way in the socializing conditions existent in the free society. However, it is defended a reform of racional and humanitary dimensions owing to, at a short or medial term, not only a large fall of the hypothesis of enforcement of freedom deprivation penalties, but as a revolutionary reduction of minimum and maximum limits predicted by a range of incriminating rules for this kind of penalties. As well as this, it is defended a reduction of the predicted limits, in the various penal legislations, as for an unification of the freedom deprivation penalties. In both cases, such limits should suit the cultural conditions of each society, not being possible to esteem maximum limits of universal value.

In both cases, such limits should suit the cultural conditions of each society, not being possible to esteem maximum limits of universal value.Neste artigo, procura-se recolocar em discussão a questão das penas privativas de liberdade de curta duração, enfatizando que os inconvenientes relativos às penas privativas curtas existem também nas penas privativas longas e, por outro lado, embora toda pena privativa de liberdade seja prejudicial ao indivíduo, quanto mais duradoura ela for, tanto mais lesiva à personalidade individual e às possibilidades de reintegração social ela será. Assim, afirma-se que não é verdade que as penas curtas de prisão sejam mais falhas, ou piores, do que as longas, como durante muito tempo se defendeu. Sustenta-se que, na realidade, o que ocorre é o contrário, pois as penas privativas de liberdade de longa duração provocam, quase sempre, uma desadaptação individual irreversível às condições de convivência social existentes na sociedade livre. Defende-se, portanto, uma reforma de cunho racional e humanitário em virtude da qual haja, em curto ou médio prazo, não apenas uma larga diminuição das hipóteses de aplicação das penas privativas de liberdade, como também uma revolucionária redução dos limites mínimos e máximos previstos pelas diversas normas incriminadoras para as penas dessa espécie. Defende-se, também, uma redução dos limites previstos, nas diversas legislações penais, para a unificação das penas privativas de liberdade.
