Of a side, the solution of the traditional criminal system; of another one, the solution brought for Restorative Justice. Thus, the article intends to demonstrate that Restorative Justice can be a possible way to change the punitive paradigm so that we can think about the conflict beyond punishment.O presente artigo pretende fazer um contraponto entre a relação desigual proporcionada pelo sistema penal atual e o modelo da Justiça Restaurativa, que vem ganhando espaço como forma mais humana e menos excludente de solução de conflitos. Para isso, é necessário analisar situações iguais ou semelhantes, tratadas pelo sistema de justiça penal tradicional e pela Justiça Restaurativa. Propõe-se, então, um estudo de caso: briga entre vizinhos. De um lado, a solução do sistema penal tradicional; de outro, a solução trazida pela Justiça Restaurativa.
