This article provides an overview of trafficking in people in Mexico for sexual exploitation from a perspective combining gender and human rights. The first section addresses the first international instruments regarding white slavery (which certainly had racial content) and trafficking in older women, which later was defined as exploiting the prostitution of others. The 1949 Convention and the Palermo Protocol were analysed, emphasising the consent of the people involved in prostitution and how each instrument addressed them differently. The second section examines the trafficking of women for sexual exploitation in Mexico: the context of social inequality, the mechanisms for capturing victims, their transfer and exploitation. A third section deals with the Colombian law for preventing and punishing the trafficking in people, which came into force in November 2007. Some conclusions are made regarding advances made in the legal field and tasks which are still pending.

Na primeira parte, abrangerse- ão os primeiros instrumentos internacionais sobre a trata de brancas (certamente de um conteúdo racial) e trata de mulheres maiores de idade, o que fora definido posteriormente como exploração da prostituição alheia. Analisar-se-ão a Convenção de 1949 e o Protocolo de Palermo com ênfase na aceitação das pessoas que exercem a prostituição, temas abrangidos por cada um desses instrumentos de forma diferente. Na segunda parte analisar-se-á a trata de mulheres com fins de exploração sexual no México: o contexto da desigualdade social, os mecanismos para capturar vítimas, o deslocamento, a exploração. A terceira parte dedica-se à Lei para prevenir e punir a trata de pessoas, que vigora desde novembro de 2007. Finalmente apresentam- se algumas reflexões finais sobre os avanços no âmbito jurídico e as tarefas ainda por cumprir.El artículo ofrece un panorama general sobre la trata de personas con fines de explotación sexual en México, desde una visión que conjuga la perspectiva de género y los derechos humanos. En un primer apartado, se abordan los primeros instrumentos internacionales en materia de trata de blancas (que ciertamente tenían un contenido racial) y trata de mujeres mayores de edad, lo que después se definió como explotación de la prostitución ajena. Se analizan la Convención de 1949 y el Protocolo de Palermo, con énfasis en el consentimiento de las personas que ejercen la prostitución, que cada uno de estos instrumentos aborda de manera distinta. En el segundo apartado se analiza la trata de mujeres con fines de explotación sexual en México: el contexto de desigualdad social, los mecanismos de captación de las víctimas, el traslado, la explotación. Un tercer apartado está dedicado a la Ley para prevenir y sancionar la trata de personas, que entró en vigor en noviembre de 2007.
