The following article deals with an analysis of the relationship
between modernity and discourse about
rights, equality and their guarantees. The relationship
between modernity and fundamental rights was defined
as being necessary for explaining the concepts
and conditions of equality in the contemporary social
and democratic state under the rule of law from
a comprehensive viewpoint. This supposed that a concept
of social theory and philosophy concerning rights
and equality could not be constructed independently
of understanding the modernity in which institutions
and social theories evolve. Some modern and contemporaneous
paradigms were dealt with concerning
rights and equality theories and their close links with
modern technical and instrumental mediations arising
from discourse concerning rights and their guarantee
and protection models. Solid, close relationships were
established between modernity and rights leading to
critically observing the split between modern conditions
regarding equality and concepts proposed by social
theory, becoming social traffic engineering. This
meant that theories which are comprehensive, difficult
to construct and complex in their application have
been assigned the task of establishing critical reunion
regarding such spilt. |
