The issue at stake is whether national authorities and economic operators may rely on the fact that the Commission will apply the criteria contained in those guidelines and, therefore, whether any decisions issued by the Commission that contradict these criteria may be contested by filing an action for annulment. The analysis focuses on the legal effects of soft law and, in particular, on the �few and contradictory� rulings issued by the European Court of Justice in relation to the Commission�s guidelines on State aid. This exercise leads the author to formulate proposals for the future, with the aim of improving the legal certainty of national authorities and economic operators.En este trabajo se analiza el valor jurídico de las directrices aprobadas por la Comisión Europea en materia de control de las ayudas de Estado aplicables a los diferentes sectores económicos, también conocidas como �encuadramientos�. Se aborda la interesante cuestión relativa a si los criterios contenidos en tales instrumentos son vinculantes para la Comisión; en otras palabras, si las autoridades nacionales y los operadores económicos pueden confiar en la aplicación por la Comisión de los criterios contenidos en dichas directrices y, por tanto, si son impugnables mediante la vía del recurso de anulación las decisiones de la Comisión que se aparten de tales criterios. Todo ello conduce a reflexionar sobre la naturaleza jurídica del soft law y, en particular, a analizar los pronunciamientos �escasos y no exentos de contradicción� que ofrece la jurisprudencia comunitaria sobre las directrices de la Comisión en materia de ayudas de Estado.
