The question for the legality or illegality of gathered knowledge -or knowledge to gather- for the criminal
procedure implies defining the actions of public authorities that exceed a previously approved scope and the consequences of these behaviors to the process. In terms of evidence, knowledge that has been obtained illegally or whose assessment violates rights of people subjected to a criminal procedure has had several different interpretations by constitutional judges, which have varied over time since the 1991 Colombian Constitution, in which the nullity of all evidence obtained outside the due process is expressly contained. The aim of this paper is to describe the interpretations developed by the Constitutional Court regarding the constitutional statement that contains a term of exclusion of such evidence obtained outside the due process (art. 29). Then it analyzes the basis for those interpretations as defined by the Constitutional Court. It also questions the relevance of those interpretations regarding the legal system, and it seeks to mention the difficulties of including the so-called exceptions to the exclusionary rule in the legal procedures, in view of the unconstitutional effects they cause. Finally, it sets forth a basis proposal to the model of the illegal evidence exclusion, in accordance with the constitutional program for the criminal procedure.

En matière de preuve, les connaissances obtenues de façon illégale ou que par l�intermédiaire de leur évaluation attentent contre les droits des personnes soumises à une procédure pénale ont eu des interprétations diverses par les juges constitutionnels à partir de la Constitution colombienne de 1991, dans laquelle s�est expressément consacrée la nullité de plein droit de cette preuve obtenue en dehors du processus dû. Cet article se propose de décrire les interprétations que la Cour Constitutionnelle a développées à propos de l�énoncé constitutionnel qui contient un mandat d�exclusion de toutes preuves obtenues en dehors du processus dû (article 29). Ensuite, l�on analyse quel a été le fondement défini par le Tribunal Constitutionnel et l�on se pose des questions sur la pertinence de ces interprétations en ce qui concerne le système juridique. L�article vise également à mentionner les difficultés d�inclure les exceptions à la règle d�exclusion de la procédure judiciaire, à la lumière des effets inconstitutionnels que celles-ci causent. On énonce finalement une proposition de fondements du modèle d�exclusion de la preuve illicite, en accord avec le programme constitutionnel pour le processus pénalLa pregunta por la licitud o ilicitud del conocimiento allegado -o por allegar- al proceso penal implica definir cuáles son las actuaciones de las autoridades públicas que desbordan un ámbito de actuación previamente autorizado y cuáles son las consecuencias de estas conductas para el proceso. En materia probatoria, aquel conocimiento obtenido de manera ilícita o que por medio de su valoración atenta contra los derechos de las personas sometidas a un proceso penal ha tenido una interpretación del juez constitucional que ha variado en el tiempo a partir de la Constitución colombiana de 1991, en la cual se consagró expresamente la nulidad de pleno derecho de aquella prueba obtenida por fuera del debido proceso. El presente escrito tiene como objetivo describir las interpretaciones que ha desarrollado la Corte Constitucional acerca del enunciado constitucional que contiene un mandato de exclusión de aquellas pruebas obtenidas por fuera del debido proceso (art. 29), para luego analizar cuál ha sido el fundamento definido por el Tribunal Constitucional y preguntarse por la pertinencia de estas interpretaciones respecto al ordenamiento jurídico. También busca mencionar las dificultades de incluir las llamadas excepciones a la regla de exclusión en el ordenamiento jurídico procesal, en vista de los efectos inconstitucionales que éstas ocasionan.
