The general rule is that any undertaking economic is going to be subordinated to the rules of common law applicable, without prejudice to those areas of business activity that by its nature imposed the establishment of special rules. This special regime has given rise to new forms of regulation in the economic sphere, in its great majority on the occasion of the importation of normative instruments compared. As well it reinserts the figure of the soft law administratively through the issuance of guidelines, directives and instructions that are often sneak into �regular� economic activities pose a dilemma if there is actually the soft law in our legal system or we will be faced with a hard law exempted from control mechanisms of formal activities of the administration.Nuestra regulación económica se estructura sobre la base de la subsidiariedad y de la libre iniciativa económica conforme al estatuto jurídico previsto en la Constitución Política de la República (CPR). La regla general es que todo emprendimiento económico queda subordinado a las normas de derecho común aplicables, sin perjuicio de aquellas esferas de la actividad empresarial que por su naturaleza impongan el establecimiento de reglas especiales. Este régimen especial ha dado origen a nuevas formas de regulación en materia económica, en su gran mayoría con motivo de la importación de instrumentos normativos comparados.
