Many of the Latin American constitutions protect collective rights of indigenous peoples. According to the research on the lives of Latin American indigenous women, there are cultural practices that do not respect their fundamental rights. This article argues that according to the constitutional rule of law, indigenous women´s rights to dignity, freedom and equality should stand before the collective rights of indigenous peoples to preserve their culture.
