Laburpena: The doctrine about the disproportionate damage was used in the last years by the Supreme Court in many occasions. In spite of that, the arguments used for its application, are not evident and even contradictories. This form is based on the existence of a damage with considerable features, which detach one presumption of negligence prescribed by the doctor. This project show of a detailed analysis about the disproportionate damage in the civil responsibility of the medical institution, which will allow the reader determine when a damage can be used in this doctrine and which are the consequences due to those application. This research, deal with this figure from a jurisprudence perspective, starting form the current doctrine in the field.
