Laburpena: The present work analyzes the solution that the Roman jurists gave to a problem derived from the urban life with the legal resources which they had at his disposition. The citizen coexistence entails, in Rome and much more nowadays, inevitable environmental disturbances and needs to establish limits and mechanisms that allow this coexistence. In order to solve this conflict, the Romans chose to consider including in the concept of «pacific possession », the right to enjoy a property without suffering the disturbances that come from other buildings. Comparing the inmissio to the acts of disturbance prohibited with the interdictum uti possidetis, and therefore granted this also against these environmental annoyances. It was a prohibited practice by the LEC 1881 in Spain, that requires animus spoliandi in the mind of the disturber, but that could be considered allowed in the present spanish regulation.
