Laburpena: ocial welfare, Social law State and Collective interest are not a recent phenomenon in Latin America. In the early XX century the operating Mexican constitution (Querétaro, 1917), inaugurated a new cycle in the recognition of the so called social rights, such as later the ephemeral Weimar constitution (1919), would do it in Germany. Both instruments pioneered in the generation of rights of the so called second generation. As it is well known, these projects were aimed to the tutelage of collective in terest of broad social conglomerates. It was meant then to protect the workers, as well as the agrarian masses and the extremely poor population in order to expand all those rights which so far were conceived as individual . There off, social rights were to be constituted as participation rights which assured the possibilities to gain access to wealth and political power. In this sense the formation of the social State and the recognition of social rights in the constitutional texts, arewhere it can be affirmed that said rights constitute one of the aspects or dimensions which endow with substance the social and democratic State. two interrelated processes, up to a point
