Laburpena: The documentary letter of credit is a payment instrument which aims to increase legal certainty and the effective realization of a commercial transaction. The documentary letter of credit will allow the parties to increase their confidence towards the realization of an effective international exchange. However, to achieve the objective, documentary letter of credit requires an adequate description of the legal relationship between the subjects involved. Accordingly, this description will determine, in the event of multiple obstacles or difficulties, the competent Court to hear the dispute and predict what the applicable law will be. And even more, to overcome the confusion created by certain countries which apply their own rules respect the documentary letter of credit, arise Uniform Customs and Practice for Documentary Credits, which impose uniformity in commercial transactions.
