Summary: This article, which is divided into two parts, examines, as its name suggests, the exceptional incident of nullity of actions performances void in Art. 228 LEC after its modification by Law 6/2007 in the field of civil procedure. The first part approaches mostly a theoretical analysis of the institution, examining its history, regulation and, of course requirements. The second part has a practical vocation, and aims to expose the assumptions on which more often it will be necessary to raise an exceptional incident of nullity of procedural steps in the civil process, analyzing the possibilities of success depending on the existing Jurisprudence in the matter. Finally, we report the conclusions reached after the investigation, examining problems that in the opinion of the author raises this regulation of the exceptional incident of nullity of proceedings, and trying to contribute possible solutions.
