Confronting the divergent interpretations about this subject, analisyng the nowadays laws and consulting courts decisions about the main presented points, it will not only analyze the proposed questions but also give an image about the present and future position of the brazilian law concerning this especie of class action.Analisa, à luz do atual sistema processual civil coletivo em vigor no Brasil, a admissibilidade de uma ação coletiva ser movida em face de uma coletividade organizada, enfrentando o problema da ausência de uma previsão legal expressa, a possibilidade de se realizar o controle judicial sobre a representação adequada, assim como a extensão subjetiva dos efeitos da coisa julgada coletiva, os principais fundamentos teóricos para a admissibilidade do que a doutrina passa a denominar de ação coletiva passiva.
