Laburpena: This articles analyses the right to have the final say as a fundamental right, directly linked to the right of defence. It is a legal mechanism which constitutes the most vivid expression of the principle of self-defense. Its relevance lies, on the one hand, on, its presence in all levels of the legal system (o legal order) and, on the other hand, on its usual application by courts. The Constitutional Court, as well as the Supreme Court and Provincial Courts have dedicated many judgements to the analysis of this criminal legal institution.
