The article refers to the concept of criminal liability as a base for an adequate
characterization of the circumstances that modify this kind of liability and for
the determination of the principles that the Chilean Constitution imposes for
the assessment of those circumstances. The analysis includes the principles of
lawfulness and non bis in idem, and also the way in which these principles are
projected in regard to the obligation to apply such circumstances. |
