John Rawls, an American philosopher, renewed the Ancient Greek ideals and created a theory of justice, in a attempt to obtain a operative concept of justice (distributive justice). That concept justifies the adoption of affirmative action. The intervention of the prosecutor in affirmative action was illustrated by a case study. The prosecutor intervenes in the public and diffuse interest defense. It is noticeable a clear alignment between Rawls´s theory and the work of the ministerial body in the analysis of public policies. The affirmative action programs require for themselves several studies, subsequent to this, seeking its improvement.
