Laburpena: The history of the prison has served to reflect on the current situation in Spain and the general theory of fundamental rights, to consider prisoners as subjects of fundamental rights. The main lines are related to the transformation of the social and democratic State of law, giving rise to a change in penal institutions and in its relations with society. Such relations have been based on the primacy of the State on the penitentiary institutions, specifying this current interest in the rights of prisoners in a reflection of the general movement in defence of human rights. This primacy has been manifest by attributing to the State the monopoly of the legitimate exercise of power and the creation of the law, incorporating in the Constitution, fundamental rights, through a system of higher values that constitute the order of political as well as inform the legal coexistence.
