The origins, aims and elements of the constitution of 1991 are different to the Constitution of 1886 due to the crisis of the Colombian political system. On December 9, 1990, the 70 constituents were chosen which came from various trends in political thought, legal, economic, and social. The Constitution of 1991 represents a paradigm shift which provides a series of elements such as the model of rule of law, fundamental rights and socio-economic, a series of judicial mechanisms and institutions for their demands, such as legal actions and the Constitutional Court, the Ombudsman, the Popular Action, valuation and respect for minorities, the Prosecutor General of the nation, including democracy. The above items have been considered by the Colombians as really adequate for the demand of their rights against the State and its entities. In addition, parents of this new chart gave a high value on the separation of powers which should be analyzed to determine their effectiveness and validity.
