Also, this paper shows how the 1991constitutional design kept the (hiper-presidencialismo) as the backbone of theorganization of public authorities, however, the 1991 Constituent, toavoid excessive control of the presidency, expanded thecounterweights. But the Legislative Act 02 of 2004 (presidentialreelection) significantly affected the checks and balances for thebalance of public power.In conclusion it could be said that Colombian democracy is part ofdelegative democracy referred to regimes where democracy is reduced tothe electoral system, giving the public power to the populistcharismatic leader ("hiper-presidencialismo" means that the figure of thepresident becomes a center of gravity of the public and even privatepower), showing a weak democracy, against which the citizen shouldtake an active and critical attitude for the sake of his defense.
