Summary: The present study focuses, initially, the ancestral immunity from jurisdiction of foreign state, through its conceptualization. Thus, it is done in a deepening its historical evolution, as well as an examination of national jurisprudence regarding the subject and the continuous changes suffered by international law in recent decades. They also studied the cases involving human rights violations and the granting of immunity from jurisdiction to States in violation, analyzing the global scene. Therefore, this entire discussion is done according to a new lens, based on the individual and the primacy accorded to human rights protection, so that victims have access to the courts of their countries, to reparations for atrocities, promoting a serious debate about the question.
