Laburpena: In this work, taking as base of consideration the Thirty¿second Final Provision of Spanish Constitution which sets the justification of the national law making power in insolvency issues, we try to state the differences outstanding between this act and the recent Second Book of the Catalonian Civil Code, relating to the person and family. From the comparison of the contents of both regulations, we could conclude the differences in the treatment of married natural persons under insolvency and the possibility of an eventual territorial implementation of the Insolvency Act, that could not only contravene the subjective unity principle stated by the regulation, but also the territorial unity principle, so as the unity of Market.
