Laburpena: Due to the pretension of the Turkish Republic to become a member of the European Union, it becomes necessary that an effective compliance with the standards established within the Copenhaguen Criteria need to be verified. Regarding the protection of the human rights, the amendment of the Turkish Criminal Law is seen as one of the main tasks due to the protection of the fundamental legal assets, which is the content of this discipline, inherently linked to the shelter of the human rights. Hence, an study related to the general principles of Turkish Criminal Law has been done, since they shape the basis and limits to the State's legal authority to impose penalties, in order to verify which kind of abuses are endorsed by them and which is the answer given both by Communitarian Institutions and Council of Europe.
