Laburpena: The author proposes an interpretation of the critic of formalism in legal discourse. Under this interpretation certain view points are formalist because they abstract some properties of the phenomenon under analysis and omit others. The formalist can assume two different attitudes concerning the omitted properties, he can show no interest, or he can pretend to account for them by propounding an evaluative judgment or a descriptive statement. According to the author the advanced interpretation allows us to recognize certain mechanisms used in argument's construction and he shows it by scrutinizing two proposals in legal theory. The author claims that under this reconstruction formalism is not yet a substantial objection. In briefly expounding some thesis of economic institutionalism he believes to have found two objections of this kind.
