It is essential, when carrying out the analysis of
the human rights developments in the Colombian
constitutional bicentennial, addressing the study of stage after a period of history and
we call constitutional internationalization as
a result of the subscription and ratification of
a number of international conventions. The
state has clear obligations in many ways, one
is obviously the duty of protection and security.
But we should not lose sight of the enhancement
of various legal concepts, such as the
principle of pacta sunt servanda, the block
of constitutionality, and the phenomenon of
globalization. It is important to consider the
legal issues of respect for human rights. Not a
problem the system of each State, in the sense
of having to respect only those constitutional
provisions, but, much more extensive, it is to
integrate, complement and harmonize domestic
law with the obligations undertaken by way
of signature and ratification of international
treaties, especially when it comes to issues relating
to human rights.
The approximation is made in this letter begins
with the primary right to life, without a doubt
the most important of all human rights and
its treatment in the constitutional period of
internationalization, with a special reflection
on the Inter-American Human Rights System
, as the stage for ultimate protection linked to
Colombia. |
