Laburpena: After coming into force, the Law 15/2005, from July 8th, that eliminates grounds for divorce in our legal system, there has been an outstanding increase of decisions that award damages for pain and suffering caused by the failure to comply with marital duties. Like in other European countries, the rules of Law of torts are applied in order to punish immoral behavior which should be regarded as an expression of freedom. The question is to determine when the failure to comply with a marital duty gives rise to damages yet avoiding bringing the concept of fault back in our Law.
