Laburpena: This article is intended to organize and systematize some ideas and understandings of the critical social science in relation to or focused on making contributions to construct a theory on social and political nature of modern law. Our exercise is to provide certain coherence to a group of texts, especially those coming for Marx�s work, which can help us having a better understanding of nature and roles of the capitalist law. In fact, the intention becomes unavoidable in our days, since we are witnessing the collapse of the juridical positivism and the endless attempts of academic and political essays to �update,� in a modern manner, old ius naturalistic thesis based on or supported by contemporary scientific development which encourages us to forget important determinants of social-capitalist relationships. Accelerated dynamism of the so called knowledge society or network society forces the critical juridical sociology to be aware of the legal sense in this globalization world.
