AB  - This paper includes the second part of a study focused on the political and juridical thinking of Emile Durkheim, who is considered as the father of French sociology and also, to a certain extent, the founder of «scientific» sociology. In this second part there is an analysis of the concept of organic solidarity, elaborated by Durkheim, and also a selection of his bibliography. This concept of organic solidarity is created from the double distinction between two kinds of Law: the repressive or penal Law and the restitutory Law. These two kinds of Law reveal two different forms or types of solidarity: the mechanic solidarity or solidarity of resemblance and the organic solidarity. The paper also remarks the most important elements of Durkheim's organic theory of the estate and democracy. Durkheim explains the democracy as deliberation among citizens, and also as deliberation among citizens and the State, where the State plays the roll of organ of reflexion and social thinking within the frame of a society based on the organic solidarity.
