AB  - The concept of state seems to have divorced from the private collective interests which should promote its actions, generating a real dichotomy between them. State contracts in general, and the concession contracts in particular are faced to this contradiction as they devalue in practice the real sense of the tendering procedures, not only for the existence of a wide repertoire of exceptions, but also as it allows the award of contracts in the event there is no proposal concurrence or through the implementation of control systems by electronic media, which are strange to the possibilities of most of the country governmental entities. In this field especially, they have ended up by denaturalizing its object as well as the rules of objective selection, not due to interpretation architectural problems but for the existence of clear tendencies, at the moment of its application, to favor particular interests, which constitutes a restraint for the development of the country.
