The plan of judicial- decree about "General rules to he practice of electronic commerce", refer to the traditional regulating in all relative affairs to the perfection of contracts, it results contradictories that Civil Code is remiss in some of institutions of this phase. To solve this problem, it is necessary to make a doctrinal, jurisprudential and legal extensive analysis, make in conclusion if we are not facing new types of contracts, it results necessary to adjust the actual legal system and the one forming.La era de la informática ha incidido en el desarrollo del comercio a escala mundial. Cuba ha visto en el e-commerce un vehículo para potenciar su comercio; por ello esta investigación parte de la polémica de determinar si la regulación jurídica cubana existente en sede contractual ofrece cobertura a los fines de regular el momento de perfección de los contratos concluidos por medios electrónicos. El proyecto de Decreto-Ley sobre "Normas generales para la práctica del comercio electrónico" remite al ordenamiento tradicional en todas las cuestiones relativas a la perfección de los contratos, por lo cual resulta contradictorio que el Código Civil es omiso en varias de las instituciones propias de esta fase.
