Laburpena: The increasing immigration flow led to the formation of cultural heterogeneous societies and with that, to the beginning talk about multicultural states. It is just the so-called multiculturalism, which brings new challenges for the criminal law due to the fact, that a determined conduct could change its evaluation according to the cultural context the delinquent belongs. In order to concretize the range of multiculturalism and how criminal law should confront it, it is indispensable to examine the theories, which try to resolve the own problem of cultural diversity, the so named liberal and comunitaristic theories. The prior allows to understand what is to comprehend under culturally motivated crimes and if, respect to the penal treatment, the answer is to be found either within the sphere of unlawfulness or culpability. Considering the multicultural character of the American society it is not possible to respond to such a question without having any knowledge of the cultural defences that arose from literature and jurisprudence.
